Terms & Conditions

These terms and conditions shall apply to your purchase of tickets for the Paradise Park Attractions. When you confirm your purchase, you are accepting that these terms and conditions form the basis of any contract between Tates of Pyecombe Ltd T/A Paradise Park and yourself.

Please read these terms and conditions carefully, particularly the section regarding cancelling or amending your tickets. By ticking the ‘I agree to the terms and conditions’ box, you are confirming that you are happy to be legally bound by these terms and conditions.

If you do not agree to these terms and conditions, you should not tick the ‘I agree to the terms and conditions’ and you should not continue with the purchase of tickets for Paradise Park.

1. Paradise Park Attractions

1.1 Paradise Park is located at Avis Way, Newhaven, East Sussex BN9 0DH.
1.2 Admission to Paradise Park is only accepted upon receipt of a valid ticket, purchased online via www.paradisepark.co.uk or in person at our main entrance reception desk.  
1.3 Your ticket must be presented in printed form or viewable on a mobile device. We reserve the right to request proof of identity before allowing admission to Paradise Park. 
1.4 Persons under the age of 16 must be accompanied by a responsible adult, aged 18 or over.1.5 You shall be responsible at all times for ensuring the correct and safe supervision of all children in your group.
1.6 Disabled visitors pay the full individual entry rate. Those visitors that receive DLA/PIP disability payments are eligible to bring one essential carer free of charge subject to DLA/PIP written evidence. Please note the evidence provided must be dated within the last two years. If evidence is not brought or not in date a full charge for entry will be required. Carers must be aged 16 or over. 
1.7 No dogs or pets admitted except for fully registered assistance dogs in a harness (proof of registration may be requested).
1.8 The management reserves the right to refuse admission for whatever reason.

2. Purchasing Your Tickets

2.1 We cannot issue any refunds, returns or exchanges.
2.2 All transactions will be in sterling.
2.3 Prices are inclusive of any applicable taxes and there are no surcharges whatsoever. Once you have paid, we will not increase the price of your tickets.
2.4 Tickets are valid only for the date specified. Please bring your booking reference number and/or email print out with you on the day of your visit.
2.5 Tickets can only be used once.  Once validated at our reception and entrance and access gained to the Park, the ticket will be void.  All and any tickets/vouchers will be retained by our reception staff.
2.6 Possession of the E-ticketing unique number or barcode will be regarded as proof of purchase and will entitle you to the relevant number and type of tickets purchased.
2.7 When a family ticket is presented, all members of the group must enter the Park at the same time.
2.8 Once purchased, on-line tickets may not be used in conjunction with any other offer. No ticket may be resold.
2.9 Online tickets do not guarantee fast track entry.
2.10 All purchasers must have a personal email address for use with this system, which will be added to our emailing database, but never passed to any other company.  You must inform us if you wish to unsubscribe.
2.11 Prices displayed on the site are subject to change without notice.
2.12 Any discounts or offers on-line are available for limited quantities and periods only and shall not be available for bookings made by phone or in person.

2.14 Only children under 3 years are admitted free of charge.  Additional tickets will be available to purchase at admissions if required at normal entrance prices.
2.15 Payments for tickets online shall be made using the online payment facility. Credit card payments use secure gateway “SagePay” and all transactions are with Barclaycard Merchant Services.
2.16 Unlawful resale (or attempted unlawful resale) of a ticket will result in the cancellation of that ticket without refund or other compensation.
2.17 We will not be responsible for any tickets that are lost or stolen. You will be responsible to ensure that you have a valid ticket ready to be inspected upon your arrival at Paradise Park.
2.18 All normal terms and conditions of entry to Paradise Park apply.

3. Cancelling or Amending Your Tickets
3.1 Tickets to Paradise Park are non-refundable.
3.2 If you have tickets for a timed event, you may be able to change your allocated time slot up to 48 hours prior to your allocated time slot, subject to availability, by notifying us by email at enquiries@paradisepark.co.uk
3.3 If you have purchased tickets for a timed event, we may cancel or reschedule your visit at any time at our absolute discretion. If a suitable timeslot cannot be found, we will then offer you a full refund.

4. Your Privacy
4.1 By providing your personal information to us when you purchase your ticket, you consent to us processing your data in accordance with these terms and our privacy policy.
4.2 The personal information you provide to us when you purchase your ticket is held by Digitickets, a third party supplier that we use to provide the online platform your tickets are booked through. Details of their privacy policy can be seen here: http://www.digitickets.co.uk/privacy-policy
4.3 Your personal information is collected and stored in accordance with the Data Protection Act 1998.

5. Liability
5.1 Our liability for any losses you and/or any of your guests may suffer as a result of us breaching these Terms and Conditions or for any breach of any statutory duty or negligence or otherwise is strictly limited to the total purchase price of your tickets to Paradise Park.
5.2 To the maximum extent permitted by law, neither we (Tates of Pyecombe Ltd.) nor any Tates of Pyecombe Ltd. directors, employees or other representatives will be liable for any of the following losses or damage (howsoever arising and whether such losses were foreseeable or not).
a. loss of data;
b. loss of profit;
c. loss of revenue;
d. loss of business or opportunity;
e. loss of goodwill;
f. disappointment or emotional distress; and/or
g. any indirect, consequential or special loss;
arising in connection with Paradise Park, or the provision of our services to you.
5.3 Nothing in these Terms and Conditions shall exclude or in any way limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any liability which cannot be excluded or limited by law.

6. Events Outside Our Control
6.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by any event outside our reasonable control (“Force Majeure Event”).
6.2 A Force Majeure Event (without limitation) includes the following:
a. Strikes, lock-outs or other industrial action;
b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
d. Impossibility of the use of public or private telecommunications networks;
e. The acts, decrees, legislation, regulations or restrictions of any government; and/or
f. High winds or any other extreme weather conditions which necessitate the closure of the location for the safety of our staff and customers.
6.3 Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to provide a suitable alternative date on which you can enjoy Paradise Park.

7. Law and Jurisdiction
7.1 These Terms and Conditions and the terms of our Privacy Policy shall be governed by and construed in accordance with the laws of England. You accept that any dispute under these Terms and Conditions and/or our Privacy Policy shall be subject to the exclusive jurisdiction of the English courts to which you submit.

8. Complaints
We accept that, despite every effort being made to ensure you have a trouble free, enjoyable family experience, things may occasionally go wrong. If you have a complaint you must inform a member of staff immediately. They will attempt to resolve the problem as soon as possible. If, however, an acceptable solution is not found and you wish to take the matter further, please email us (enquiries@paradisepark.co.uk) detailing in full the nature of the complaint, wherever reasonably practicable within 7 days of your visit. This will allow us to investigate your complaint fully.
